If you want to buy champagne from us or use our web site you can only do so on these terms and conditions, and by registering on the web site you are agreeing to be bound by them. Although they are written in small print, we hope you will agree that they are designed to be fair to you and to us. We may change these from time to time by updating this posting.

1 Customer Promise
1.1 Quality - If you buy any of our champagnes and you don't like a bottle, we will credit your account for the full amount for that case, including delivery, as soon as we have collected the rest of the wine from you, provided of course that you have only opened one bottle from the case.
1.2 Price guarantee - We guarantee great value. That means that if you buy champagne from us and then find the same champagne for sale in the UK at a cheaper price within 14 days (but not on promotion, special offer or in a sale) we will refund the difference.
1.3 Delivery - Delivery is dependent upon the options that you pick in our on line store. We will deliver your wine to anywhere in the United Kingdom (including Northern Ireland, the Scottish islands, the Scilly Isles, the Isle of Man and the Isle of Wight. Deliveries to these locations will attract an additional delivery charge. Unfortunately we are unable to deliver to the Channel Islands or other British Dependent Territories).

We normally deliver Monday to Friday, between 9.00am and 5.00pm. Same day deliveries are subject to a premium, orders must be placed and acknowledged between 9.00am and 2.00pm of the day of the order, this service is only available in the North East of England…..at the moment. Saturday AM deliveries (within the North East of England) are made between 8am and 12 noon, if you require this service you must have placed an acknowledged order by 2.00pm of the previous day at the latest. If you are a B2B customer please designate the person who is going to accept delivery, if you are a private individual and you are going to be out you can give us instructions to leave the champagne at an adjacent address (a close neighbour) as this is by far the easiest way to ensure you get your champagne on time. All that we need is the name of somebody who is entitled to sign for its receipt. The signatory must be over 18, if you or your designated alternate are unavailable a card will be left as proof of an attempted delivery.

If you prefer to have the champagne delivered to you in person, we will of course do so. If you are not there the driver will leave a card for you to arrange a mutually convenient delivery time, should you require a specific time this can be arranged but may attract an additional charge. If we have not attempted to deliver your champagne within seven days of you placing an order and it is in stock, then we will refund the delivery charge to your lovely Bubbly account for you to offset against your next order, unless you insist on having the champagne delivered to you personally and are out when the driver attempts delivery. Just to be clear, if the driver leaves a card because you are out, then this will count as an attempted delivery.
1.4 Breakages - If you find on delivery that one, some or god forbid, all of the bottles in a case are broken we will replace it at no cost to you or refund your account. However you MUST note all breakages on the consignment note at the point of delivery, if there is nothing on the note you are deemed to have accepted a complete order.
1.5 Availability - Champagne is an agricultural product and runs out from time to time. If you order a case of Champagne, and we are out of stock, we will give you the opportunity to advance order against our next delivery, or we will suggest an alternative of at least the same quality.

1.7 Customer satisfaction - if you are dissatisfied with our performance in any way, please contact our customer services department immediately on 0845 2572754. At Lovely Bubbly, we aim to deal with all enquiries fairly, confidentially and quickly. We will acknowledge your contact within 24 hours. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved. 1.8 Right To Terminate - This Customer Promise is here for the good of all of our customers. If we feel that it has been abused, we reserve the right to close your account, by inactivating it, once we have met our obligations under this promise. If we do inactivate your account, and you choose to make another purchase, whether through that account or any other, then our obligation to you for any claim will be limited to your statutory rights and we will not be bound to deliver our full Customer Promise

2 Prices and payment
2.1 All prices are quoted in pounds sterling, and may be per bottle or per case, as marked. The prices include Value Added Tax, unless otherwise specified. Any delivery charges are additional.
2.2 We accept payment by Switch, Visa, MasterCard and Amex, through our Metacharge account.

3 Age restriction
3.1 We won't sell champagne to anyone who isn't 18 years old or over. Sorry, but that's the law. By placing an order you confirm that you are at least 18 years old.
3.2 If you are buying a case of champagne as a gift - the recipient must also be over 18 years old.
3.3 If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the champagne is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the champagne.
3.4 Sorry to have to state the obvious, but once the champagne has been delivered, according to your original delivery instructions, it becomes the recipient's responsibility.

4 Security
4.1 If you are nervous about shopping on the web, don't be. We use secure servers with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information. Additionally, we have security measures in place to protect our customer database and access to this database is restricted internally.
4.2 All Credit and debit card transactions are processed by Metacharge.
4.3 It is your responsibility to protect your password from being disclosed to any third party.

5 Cancellations
5.1 You may cancel your order for any reason whatsoever at any time up to 7 working days from the day after the date you receive your wine, provided all of the bottles are unopened and intact
5.2 In order to cancel your order you must call us on 0845 2572754,fax us on 0709 2872868 , notify us by email on sales@lovelybubbly.co.uk or in writing to Lovely Bubbly Ltd, PO Box 330 Gosforth, Newcastle upon Tyne NE3 1ZS.
5.3 We shall reimburse the price of the Champagne within 30 days from the date you notify us of the cancellation. It is your responsibility to hold onto the Champagne and take reasonable care of it until we come to collect it.

6 Returns
6.1 If some or all of the bottles of Champagne in a case are broken or spoiled when they are delivered you should notify us as soon as possible. You may choose either to return the whole case or just the affected bottles for a refund. Please note that we have included guidelines on how best to enjoy champagne on our website, please follow them they are there to help you!
6.2 You must notify us of all Champagnes which are due to be returned for any of the reasons stated in this clause within 90 days from delivery of the Champagne, otherwise you cannot rely on Clause 6.1 above. You can call us on 0845 2572754,fax us on 0709 2872868, notify us by email on sales@lovelybubbly.co.uk or in writing to Lovely Bubbly Ltd, PO Box 330 Gosforth, Newcastle upon Tyne NE3 1ZS.
6.3 All refunds and reimbursements under clause 6.1 will be paid within 30 days of you notifying us of your wish to return wine under that clause, provided the champagne has been collected by our carrier.
6.4 Any Champagnes collected by our carrier must be in their original box to avoid further breakages, where possible.
6.5 Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen's Advice Bureau.

7 Intellectual Property Rights
7.1 You agree and acknowledge that we own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site, and to the business of Lovely Bubbly including the software, the structure, design and layout of the web site.
7.2 You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
7.3 All persons, individual and corporate, are prohibited from providing hypertext or other links to the lovelybubbly.co.uk web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.

8 Warranties
8.1 We warrant that the Champagnes will be of satisfactory quality and fit for their general purpose.

9 Limitation of liability
9.1 Nothing in these Terms and Conditions shall exclude Lovely Bubbly's liability for personal injury or death caused by its negligence.
9.2

We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

i. loss or damage was not foreseeable to both parties when the contract was formed;
ii. loss or damage was not caused by any breach on the part of the supplier;
iii. Loss or damage relates to business and/or non-consumers.
9.3 Subject to 9.1 we will not be liable for loss or damage caused by the customer handling the Champagne. In particular we will not be liable for spillages or breakages.
9.4

Customers should also be aware of the following inherent risks and warnings:

i. Alcohol should be consumed in moderation, please enjoy responsibly.
ii. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
iii. Sparkling wines and champagnes can be volatile due to the build up of gasses extra care should be taken when opening them.

10 Data Protection
10.1 By providing your details to Lovely Bubbly on our web site, you consent to Lovely Bubbly maintaining, recording, holding and using the information you give Lovely Bubbly at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.
10.2 Lovely Bubbly Privacy Promise. We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your Champagne to you, e.g. our delivery company. From time to time, Lovely Bubbly Ltd may send information about discounts, free stuff and personalised offers o champagne, including forthcoming event information and exclusive deals, unless you have told us not to do so by ticking the 'opt out' box on our registration page or on the communications preferences section of Account Details.
10.3 If you opt-out from hearing from Lovely Bubbly, you will only be contacted by us if our terms and conditions change, but we promise to do so no more than twice a year.

11 General
11.1 We shall not be liable for any delay in delivering your Champagne if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, , fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
11.2 Lovely Bubbly may change or add to these terms and conditions for security, legal or regulatory reasons. We will not use this right to vary the terms of any special offer that applies to you.
11.3 The sale of the goods takes place only when the Champagne is despatched from our warehouse. Until that time, no charge will be made to your credit card and Lovely Bubbly will not be bound to supply the goods at the price.
11.4 Relevant United Kingdom law will apply to these terms and conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction. Here are our details should you want to contact us:

12 Corporate Orders
12.1 Corporate Definition
A corporate order is an order where the corporate customer places their order through the B2B (Business to Business) portal on our website, they are free to print off their online VAT invoice, no other Invoice either paper or electronically will be issued.
12.2 Delivery Address(es)
Where an order(s) contain(s) goods to be delivered to more than one delivery address, it is the responsibility of the corporate customer placing the order(s) to ensure that all delivery address(es) provided to Lovely Bubbly are correct. If goods are delivered to an incorrect address(es) as a result of incorrect information provided by the corporate customer, Lovely Bubbly will not take responsibility for this and the corporate customer will be charged for the cost of replacement goods and the cost of delivering the replacement goods to the correct address(es).
12.3 Payment
We accept payment from corporate customers by Switch, Visa, Mastercard, Amex, bank transfer and cheque. In the case of payment by bank transfer and cheque the order(s) will only be shipped when cleared funds have been received in Lovely Bubbly bank account.
